Hey! Laurier! Rules Apply To You, Too!

So, not only are the Laurier Golden Hawks looking more and more like cheaters — intentional or not — but they're also sore losers.

The CIS on Wednesday ruled 27-year-old defensive end Dave "Old Man" Montoya is ineligible to play the remainder of the OUA football season. And, furthermore, for having allowed him to suit up and play in a victory against the Toronto Varsity Blues, the CIS stripped the Hawks of the win — but not if the Hawks can help it.

Seems Old Man Montoya and the Hawks haven't given up on rewriting their selective history; a history that sees Montoya as somehow, some way having eligibility remaining.

Laurier plans to file another appeal to independent sports arbitrator Sport Dispute Resolution Centre of Canada (SDRCC).

Laurier athletic director Peter Baxter whined, err, pleaded his and Montoya's case to Christine Rivet of the Waterloo Region Record.

“We feel this rule is patently unfair and unjustly punishes student-athletes like David,” Baxter said.

“The rule was ambiguous when it was published on Aug. 25, after football camps had started.”

Just a quick question for Baxter: Was the rule just as ambiguous when it was voted on and approved as is in June?

Rivet reports Montoya, a high school teacher, enrolled in two online courses and a night business course in an effort "to upgrade his education in the hopes of fast-tracking his teaching career."

Fast track? Really? Why rush now? Because as it looks, Montoya certainly wasn't in much of a hurry during the winter or summer.

Montoya, if you remember, enrolled at Laurier in January and then promptly withdrew. And it's never been reported that he registered for any sort of summer course.

Don't get me wrong, Montoya and Laurier are well within their rights to exercise the appeals process to the fullest. But please, this is now a matter of integrity. Have some. Please.

In essence, you're fighting for a man to play amongst boys.

Is Montoya really the student-athlete every AD, such as Baxter, craves? Is it really fair to have some man who can't give up the dream come back, take some fly-by-night courses for himself and take a position away from a future five-year athlete?

You're not fighting for the student-athlete, because if you were, you'd be fighting for more funding, a higher profile for the sport and more scholarships.

No, more than anything you're fighting to save face.

Oh sure, you "self reported" the infraction. But that's like Bernie Madoff taking your grandma's retirement fund and calling her to confess as the Feds are walking up his driveway. How honourable.

And believe me, no one likes to lose. To anyone. And losing to Toronto could be viewed as particularly embarrassing. But when your cross-town rival Waterloo Warriors did two years ago, at least they did so while fielding a legal complement of players.

The Hawks are fortunate to only be giving up one win out of the three games in which Montoya played. Ironically? Fittingly? Coincidentally? It was his team's defence — and, yes, anemic offence — that cost the Hawks a win against the rival Western Mustangs, who beat the Hawks 46-1. And the McMaster Marauders squeaked by the Hawks 26-24. Montoya played in both losses. Ineligibly, mind you.

The rules are clear:

The CIS in June decided to limit a football player's eligibility to five total years to be played within seven academic years of his high school graduation date.

Players who were in the midst of their careers were grandfathered in, meaning they could finish their eligibility according to the rules in place when they entered the CIS.

But that exemption doesn’t apply if the player is re-entering the CIS and didn’t hold an "Eligibility Certificate" in 2009-10.

The rule is cut and dry. Seriously. It is.

And, if you don't believe me, Click here to read it yourself on Page 13.

It's easy to see why Baxter and Montoya missed the rule change. It's only bolded. Not bolded and italicized.

Memo to Montoya and Laurier athletic director Peter Baxtor: If Cher couldn't do it, what makes you think you can?

Give up now and save yourselves further ridicule and embarrassment. And for love of the game, after having endured a turbulent start, at least allow the rest of the OUA season move smoothly forward. Because, as it stands, teams — and now maybe the playoffs — are now waiting on your selfishness and arrogance.

Not that many are surprised. After all, the CIS and CCES had to wait for Laurier during the steroid sweep in the off-season after miscommunication conveyed by the Hawks led CCES testers to the wrong facility.

Believe it or not — like it or not — the new rules apply to all 26 teams. Yes, even Waterloo when it returns. Twenty-four of them could play fairly by them. The question is: Why won't Laurier?

Funny story... 10 of the 26 teams the rules apply to got "caught" by this rule.

How is it that 1/3 of the schools that play football weren't aware of this rule and what it would have meant to their players? Do you think they were all trying to "cheat".

How many players as old or older than Montoya are currently playing in CIS football? Have you even looked?

Or better yet in any other CIS sport? Haley Wickenheiser comes to mind... or maybe Mike Danton?

I have no issue with the 5 in 7 rule, but don't implement a eligibility rule 2 months after it is passed without the AD's seeing the final written version until August.

P.S the CCES admitted they screwed up the location of the drug test. Laurier had nothing to do with it. Unfortunately, they probably felt that looking incompetent would hurt their funding level and didn't disclose that.

Especially with all the juicy coverage of nailing the UW players.

P.S.S If Laurier (& SMU) lose their appeal, then they forfeit their win.

If they win their appeal to the SDRCC and they rule that the CIS is in the wrong with their rule and it's implementation, how does what you just wrote look?

Never assume the league is infallible. We don't with the NHL, NBA or MLB, why does the CIS get a pass?

Considering that the UW player charged with drug offences allegedly had "thousands" of pills, no concerted effort has been made to apply the same scrutiny to WLU football. You mean to tell me that his *ONLY* customers were UW football players? That strains credulity.
